- Master Recording Rights
- Publishing Rights
- Copyrights
- Intellectual Property Rights
By uploading content to SMSound India, you confirm that you own or have obtained all necessary rights, licenses, permissions, and authorizations required for digital distribution.
2. Artist Responsibility
The Artist is solely responsible for all content submitted to SMSound India, including but not limited to:
- Sound Recordings
- Musical Compositions
- Lyrics
- Artwork
- Videos
- Metadata
- Artist Names and Branding
The Artist warrants that all uploaded content is original or properly licensed and does not infringe upon any third-party rights.
SMSound India acts solely as a music distribution service provider and does not assume responsibility for verifying ownership beyond its standard review process.
3. Copyright Infringement
The following activities are strictly prohibited:
- Uploading copyrighted material without authorization
- Unauthorized use of samples, beats, instrumentals, or recordings
- Distributing content owned by another individual or entity
- False ownership claims
- Misrepresentation of copyright ownership
Any violation may result in content removal, royalty withholding, account suspension, or account termination.
4. Copyright Complaint Procedure
If a copyright owner believes that content distributed through SMSound India infringes their rights, they may submit a copyright complaint containing:
- Full Name of the Copyright Owner
- Contact Information
- Description of the Copyrighted Work
- URL or Details of the Infringing Content
- Proof of Ownership
- Statement Made in Good Faith That the Use is Unauthorized

5. Investigation Process
Upon receiving a valid copyright complaint:
- SMSound India will review the complaint.
- The Artist will be notified of the claim.
- The Artist will be given up to three (3) working days to provide proof of ownership or authorization.
- During the investigation, SMSound India may temporarily restrict, suspend, or remove the content.
- If sufficient evidence is not provided, the content may be permanently removed.
6. Three-Strike Policy
SMSound India operates a Three-Strike Policy for copyright violations.
- First Violation: Written Warning
- Second Violation: Final Warning and Account Review
- Third Violation: Permanent Account Termination
For severe or intentional infringement, SMSound India reserves the right to terminate an account immediately without prior warning.
7. Limitation of Liability
SMSound India serves solely as a distribution platform and is not responsible for copyright disputes arising from content uploaded by Artists.
The Artist agrees to assume full responsibility for any claims, damages, losses, legal actions, costs, or liabilities arising from their content.
SMSound India shall not be liable for:
- Copyright Disputes
- Ownership Conflicts
- Legal Claims
- Financial Losses
- Content Takedowns
- DSP Enforcement Actions
8. Indemnification
The Artist agrees to defend, indemnify, and hold harmless SMSound India, its owners, employees, affiliates, contractors, and partners from and against any claims, damages, liabilities, costs, legal fees, or expenses arising from:
- Copyright Infringement
- Trademark Infringement
- Ownership Disputes
- Unauthorized Content Distribution
- Violations of Applicable Laws
9. Policy Updates
SMSound India reserves the right to update or modify this Copyright Policy at any time. Updated versions will become effective immediately upon publication on our website.
